I have spent the last 4-years in prison due to a sentence passed down by the legal system of Indonesia resulting from the accusation of a mark-up of the Industrial Forest project owned by PT. Menara Hutan Buana (MHB), which is alleged to have caused a financial loss to the State. During all this time I have maintained my innocence. The role that I played in developing an Industrial Forest has in no way been in breach of State Regulation number 7 of the year 1990 (7/1990), and the Joint Letter of Decree issued by the Ministry of Forestry and the Ministry of Finance.
The amount IDR 100,931,585,000 (one hundred billions nine hundred and thirty one millions five hundred and eighty five thousands Rupiah), stated in the Joint Letter of Decree issued by the Ministry of Forestry and the Ministry of Finance, was simply a loan. It was, in fact, not only just a loan earning 0% interest per year until the felling period, it was, also, a capital investment that was to be returned during the felling period. The loan was based on a Joint Letter of Decree. This was, further, strengthened by the Notarial Deed which clearly stated the repayment periods. How could this be considered as a loss to the State by the District Attorney and the Judges?
If there were problems in the loan agreement then it should have been regarded as a civil case. Instead, why did the District Attorney and Judges insist relentlessly that this was a criminal case committed by the company, MHB? The loan was issued in accordance to State Regulation number 7/1990 and the Joint Letter of Decree issued by both the Ministry of Forestry and the Ministry of Finance. Yet the legal system in Indonesia is callous enough to interpret this as a criminal case and to sentence me to 4-years imprisonment.
